Opponents of a 500-megawatt gas and diesel power plant in southeast New Brunswick are going to court challenging the Energy and Utilities Board approval of the plan.
An application for judicial review filed June 26 with the New Brunswick Court of Appeal calls for the board’s decision to be quashed and a new hearing held. The court filing indicates a hearing on the application will take place Sept. 15.
The application alleges the board’s decision was inadequate and incoherent, failed to consider submissions from interveners and lacked procedural fairness.
