A Moncton judge has rejected a request from Daniel Bard’s lawyer to be taken off the fraud case because of health problems he anticipates will pull him from the trial down the road.

About 30 seconds into a hearing on Monday about the timeliness of Daniel Bard’s trial on alleged financial crimes, his defence lawyer said, “I’m making a motion to be removed.”

Nelson Peters told provincial court Judge Anne Richard that he is not able to continue with the trial because the complexities of the case will be too hard on his health.

“I’m hoping to avoid a potential health event,” Peters said. “I believe that this is a two-person job. I am at a severe disadvantage.”

Richard denied the request, meaning Peters must stay on as Bard’s lawyer for a hearing currently underway and a potential retrial.

“Everybody has to put their specific attention to making sure matters proceed in an expeditious manner,” Richard said about the case, which has seen multiple delays over three years.
