A Moncton judge has dismissed Daniel Bard’s second attempt to have the proceedings against him stayed on grounds that they took too long.

Provincial court Judge Anne Richard took about 15 minutes before delivering her decision after she heard from defence and Crown lawyers on Tuesday.

Richard said Bard’s second application under the Jordan rule was “devoid of any legal foundation.”  

The Jordan rule sets time limits for criminal trials to be completed so that they meet the Charter right to a trial within a reasonable time. 

Bard’s lawyer, Nelson Peters, argued that delays caused by the prosecution took the proceedings roughly three months past the 18 month Jordan time limit.
