‘Angst’ over using binding arbitration too soon, says aviation expert
John Gradek, faculty lecturer in aviation management at McGill University, says that while the strike presents a significant disruption in the aviation world, he doesn’t believe that the federal government will intervene in the next 12 hours.
“I doubt it. I doubt it very much,” Gradek said, predicting that it will hold off on intervening for two days at least.
Gradek said they could consider using Section 107 of Canada’s Labour Code, which allows the labour minister to order binding arbitration and end work stoppage. However, “there’s a lot of angst about using 107 again,” he said.
Last August, the feds invoked Section 107 less than 12 hours after Air Canada flight attendants walked off the job.
Gradek also noted that Westjet is obligated to call all the passengers individually and offer them alternative transportation to their destination within 48 hours of their original flight. If that’s not possible, customers can seek a cash refund in their original form of payment.
